Research Activity

The purpose of the research activity done by the Center is to conduct fundamental studies in the field of international and comparative law, increasing the importance of these researches in Russia. Moreover, the results are important for implementation of the science-based education policy.

The main topics are inequality in education and accountability in education.

The choice is due to the fact that these topics, firstly, are the key topics in modern international research in the field of education law. Secondly, they are poorly developed in the Russian legal doctrine and the existing research is not integrated into international scientific community. Thirdly, they cover a wide range of problems in modern Russia’s education policy.

In addition, the Center conducts work on analysis of judicial practice (the Federal Constitutional Court, the Supreme Court, arbitration courts, courts of general jurisdiction, ECHR) concerning education and also pays attention to implementation of the various rights in the field of education laid down in the legislation.

Inequality in education

Study of inequality includes the study of differences in realization of the right to education, barriers to equal access to education, existing mechanisms and legal instruments that can help to overcome inequality.

Main research tasks:

— Identification of key barriers that prevent everyone from gaining access to education;

— Identification of legal mechanisms for overcoming inequality in education;

— Comparison of the main barriers to an equal education in Russia and other foreign countries;

— Identification of the barriers that are taken into an account and not taken into an account by the Russian legal system;

—  Comparison of the main mechanisms for overcoming inequality in Russia and other foreign countries;

— Identification of the foreign mechanisms that can be suitable for Russia;

— Formulation of the recommendations to the State Duma of the Russian Federation, the Government Russian Federation, the Ministry of Education and Science of the Russian Federation in order to improve the legislation and overcome inequality in education.

Accountability in education

Study of accountability in education includes the study of contradictions in interaction mechanisms of accountability in education, basic rights and obligation of the participants of the education process, right to choose the form of education, right to education on an individual curriculum, academic freedoms for teaching staff, public participation in education (parental control, etc.). Perhaps, the description of the mechanisms of accountability in education will be the first in Russian science.

Main research tasks:

—  Identification of the mechanisms of accountability, autonomy and decentralization in educational relations;

— Identification of the degree of public and parents’ participation in the process;

— Assessment of the state and non-state involvement in the accountability system;

— Description of the management system in education organizations and management of teaching staff;

— Assessment of the balance between accountability, autonomy and rights of the participants of the education process based on the analysis of existing legal conflicts;

— Proposal of the possible ways of reforming the existing mechanisms of accountability in education in Russia based on the analysis of the best foreign and Russian practices.
